Below is a detailed terms and conditions document for balloon decoration and material setup for events. 

1.1. These Terms and Conditions constitute a legally binding agreement between the Client and Kirks and Co Balloon Decor and Events for balloon decor setup services.
1.2. By booking our services, the Client agrees to these terms in full.

2.1. A non-refundable deposit of 50% is required to secure the booking.
2.2. The remaining balance must be paid in full 24 hours prior to the event date.
2.3. Bookings are only confirmed once the deposit is received and a signed agreement is in place.
2.4. Last-minute bookings (less than 7 days prior to the event) may incur additional fees and are subject to availability.

3.1. Any changes to the order (design, quantity, or setup) must be requested at least  7 days  before the event. Additional charges may apply.
3.2. Cancellations must be made in writing. Deposits are non-refundable, but payments beyond the deposit may be refunded based on the notice period:

• 50% refund for cancellations made 3 days prior to the event.
• No refunds for cancellations made within 2 days of the event.
  3.3. The Company reserves the right to cancel the booking due to unforeseen circumstances, with a full refund provided.
• For weather related circumstances, a credit can be provided per discussion of rescheduled date or 50% deposit will be given if event is cancelled. 

4.1. The Client must provide access to the venue for setup at the agreed time. Delays in access may result in incomplete decor.
4.2. Setup includes installation of all agreed decor. The Client must approve the final setup before the Company leaves the venue.
4.3. Delivery and setup fees are included unless otherwise stated. 

5.1. The Company will use its best efforts to match colors and designs as agreed but cannot guarantee exact matches due to variations in materials and lighting.
5.2. Any changes made during setup outside the original design plan will incur additional charges and the changes must be communicated and agreed upon. 

6.1. Balloons are sensitive to temperature changes and sharp objects. The Company is not responsible for damages to the decor after setup is complete.
6.2. Helium balloons typically last 8-12 hours, and air-filled balloons can last 24 hours or longer depending on conditions.

6.3. Outdoor setups are at the Client’s risk. The Company is not liable for damages caused by weather or environmental factors. Additional fees can be incurred for weather 85 degrees and higher. 

7.1. The Company is not responsible for injuries, damages, or losses caused by the balloon decor after setup.
7.2. Any damage to the decor caused by the Client or their guests will be the Client's responsibility.
7.3. If the venue imposes restrictions or damages the decor, the Company is not liable for replacements or refunds.

8.1. The Client is responsible for disposal of balloons after the event unless teardown and disposal services are booked in advance.
8.2. Teardown services are available for an additional fee of $25 and must be arranged at the time of booking.

9.1. The Company disposes of balloon material for an additional fee. It is recommended that all balloons be disposed of properly.
9.2. Balloon releases are discouraged and will not be part of the service offering due to environmental impact.

10.1. The Company is not liable for failure to perform services due to events beyond its control, including natural disasters, extreme weather, power outages, or other emergencies.

These Terms and Conditions are governed by the laws of Milwaukee, Wisconsin. Any disputes will be subject to these laws.

By booking our services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
